Re: Continuing Criminal Detention of Namdi Kanu
Dear Mr. President:
You confront a choice between becoming a firefighter or being the fire. The former would crown you with a Nobel Peace Prize. The latter would consign you to Dante’s Seventh Circle of Hell in Divine Comedy.
You would become a firefighter by immediately ending the criminal, illegal detention of Namdi Kanu as ordered by the United Nations Working Group on Arbitrary Detention over a year ago.
You will be the fire if you desist and continue Nigeria’s contempt for the Working Group’s decree.
How can you expect the rule of law to prevail when the Government of Nigeria itself exemplifies lawlessness, including the illegal attempted assassination, kidnapping, and torture of Namdi Kanu prior to his continuing indefinite criminal detention?
On multiple occasions, the Nigeran government arbitrarily denied me the right to meet with my client or to be present in the courtroom to observe Nnamdi Kanu’s proceedings and to consult (but not act as a licensed Nigerian practitioner). I had only the law as my sidekick, which apparently was terrifying to a Nigerian government without legal guardrails.
Namdi Kanu is every bit or more the leader of Biafrans as Nelson Mandela was for South Africa’s blacks. Nnamdi Kanu is fighting persecution, crimes against humanity, and genocide of Biafrans: Python Dance 1; Python Dance 2; mass killings; pillage; torture; rape; forced labor; and bombings. In sum, the Holocaust sans gas chambers. Apartheid was benign in comparison.
Namdi Kanu recognizes that for Biafrans the alternative to Biafran statehood is extinction at the hands of Fulani terrorists. He has chosen life over death bravely risking that last full measure of devotion for that just, noble, and enlightened end.
You should tremble by reflecting the God is just and that his justice will not sleep forever.
Nigeria was born of Britain’s criminal colonization of Africa with national boundaries illegally drawn without the consent of a single African. As the American Declaration of Independence instructed, all governments derive their legitimacy from the consent of the governed to honor unalienable rights to life, liberty, and the pursuit of happiness.
Britain’s colonial rule over Nigeria was flagrantly illegal from day one—including the 1914 forced amalgamation of the Fulani, Yoruba, and Igbos who had previously enjoyed independent dispensations. Indeed, the British negotiated treaties with Biafran chiefs in the 1800s.
Britain stole Biafran sovereignty like it stole Benin Bronzes. But while it belatedly returned the looted art, it has labored against returning Biafran’s independence which it fenced to Nigeria in 1960. Britain supported the illegal Government of Nigeria in the genocidal 1967-1970 Civil War provoked by the instant trashing of the Aburi Accord calculated to protect Igbos from extermination.
Your predecessor threatened a second edition of the genocide if Biafrans continued to champion their internationally guaranteed and protected right to self-determination.
A free and fair referendum on Biafran nationhood would command universal approval by Ibos just as South Sudanese voted universally to separate from Sudan in 2011.
As regards Namdi Kanu and Biafran independence, the facts are against you. The law is against you. All you have is violence and bribery, as morally bankrupt as the British signature ditty during its colonization of Africa: “Whatever happens, we have got, the Maxim gun and they have not.”
You will be execrated by history if you bypass the opportunity to honor justice and the rule of law by releasing Namdi Kanu and negotiating a peaceful segue to a Biafran independence referendum.
Take a lesson from South Africa. After a more than four decades of apartheid, President F. W. de Klerk released Nelson Mandela from Robbin Island and negotiated an end to black subjugation. For his political courage, vision, and magnanimity, President de Klerk was awarded the Nobel Peace Prize in 1993 jointly with Mandela.
You can earn a chapter in Profiles in Courage by doing the right thing. Persisting in the wrong thing will win you no respite. In the matter of Nnamdi Kanu’s release from criminal detention, imprint in your mind that the work goes no, the cause endures, the hope still lives, and the dream will never die until fulfilled.
I expect the courtesy of a substantive response. The guilty scamper away like a watchdog who returns to the kennel when danger surfaces.
